The decision of the Office of Scottish Charity Regulator will "set a precedent" for its English counterpart, according to Alan Boyd, a charities specialist with McGrigors law firm.
Last week four idependent schools in Scotland were warned by the body to improve their bursary scheme or risk losing their charitable status, as well as associated tax breaks.
Barney Norhover, of Veale Wasbrough Lawyer, told the Times Educational Suppluemnt: "OSCR's approach can only increase the likelihood that independent schools in England and Wales will be expected to demonstrate most of their public benefit by offering means-tested fee support."
Independent institutions in these countries will be scrutinised by the Charity Commission from April next year.
